Defective assignment contributes to patent invalidity

In an infringement case before the English High Court a granted patent based on an international patent application, that claimed priority from a US patent application, was held to be invalid due, in part, to a defective assignment of rights. As a consequence of the assignment the application lost its claim to priority with the result that the patent was held to be obvious in light of material published during the priority period.
